THIS NOTICE DESCRIBES HOW MENTAL HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN ACCESS THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our Legal Duties

Cultivate Counseling is required by federal law (HIPAA) and applicable state laws in South Dakota, Minnesota, and North Dakota to:

  • Maintain the privacy of your protected health information (PHI)

  • Provide you with this Notice of Privacy Practices

  • Follow the terms of this Notice currently in effect

Protected health information includes information that identifies you and relates to your mental health care, treatment, or payment for services.

When state laws provide greater privacy protections than HIPAA, Cultivate Counseling follows the stricter standard.

Uses and Disclosures for Treatment, Payment, and Health Care Operations

We may use or disclose your PHI without your written authorization for the following purposes:

Treatment

To provide, coordinate, or manage your counseling services. This may include consultation with other licensed professionals as permitted by law.

Payment

To bill and collect payment from you, your insurance provider, or another responsible party.

Health Care Operations

For practice operations such as supervision, training, quality assurance, licensing, audits, and legal compliance.

Telehealth Services

Cultivate Counseling may offer counseling services via telehealth to clients located in South Dakota, Minnesota, and North Dakota, when clinically appropriate and legally permitted.

Reasonable safeguards are used to protect your privacy during telehealth sessions. However, all electronic communication carries some level of risk. By participating in telehealth, you acknowledge and accept these risks.

Counseling Services for Minors

When counseling services are provided to minors, parental or guardian rights of access to records are handled in accordance with HIPAA and applicable state laws.
In some circumstances, minors may have rights to confidential services, and access to records may be limited as permitted or required by law.

Uses and Disclosures Requiring Written Authorization
